By using GROWBZ, you agree to these terms. If you don’t agree, please don’t use the service.
These Terms of Service (“Terms”) form a binding agreement between you (“you”, “Customer”) and [Company Legal Name] (“GROWBZ”, “we”, “us”) governing your access to and use of the GROWBZ web application, mobile apps, APIs and related services (collectively, the “Service”).
By creating an account, clicking “I agree”, or otherwise accessing or using the Service, you confirm that you have read, understood and accept these Terms, and that you are authorised to bind the business you represent.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not have such authority, you must not accept these Terms or use the Service.
GROWBZ is a cloud tool to manage catering leads, quotes, events, invoices, menus and staff.
GROWBZ provides a cloud-based customer relationship and business management platform built for caterers, including lead capture, quotation, event scheduling, menu planning, staff coordination, invoicing and reporting features.
We may add, modify or discontinue features from time to time to improve the Service. We will use reasonable efforts to notify you of material changes that adversely affect your use of a paid feature.
Give accurate details when signing up, and keep your login credentials safe. You’re responsible for activity on your account.
To use the Service you must register for an account and provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your account credentials.
GROWBZ is not liable for any loss or damage arising from your failure to safeguard your account credentials. We strongly recommend enabling two-factor authentication.
Paid plans are billed in advance (monthly or yearly) in Indian Rupees. Fees are non-refundable except where required by law.
The Service is offered under subscription plans described on our pricing page. By subscribing to a paid plan you authorise us to charge the applicable fees to your chosen payment method on a recurring basis until you cancel.
Except where required by applicable law, all fees are non-refundable, including for partially used billing periods. Downgrading a plan may cause loss of features, capacity or data.
Free trials are 14 days, no card needed. When it ends, pick a paid plan or your account pauses.
We may offer a free trial of the Service for a limited period (typically 14 days). The trial gives you access to designated features at no charge and does not require payment details to begin.
Use GROWBZ lawfully and fairly. Don’t abuse the platform, upload illegal content, or interfere with others.
You agree to use the Service only for lawful business purposes and in compliance with these Terms and all applicable laws, including India’s data protection and consumer protection regulations.
You must not, and must not permit any third party to:
Your business and customer data stays yours. We only process it to run the Service, per our Privacy Policy.
As between you and GROWBZ, you retain all right, title and interest in and to the data you and your team submit to the Service (“Customer Data”). You grant us a limited licence to host, process and transmit Customer Data solely to provide and support the Service.
We will never sell your Customer Data. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.
You are responsible for ensuring you have the necessary rights and consents to submit Customer Data, including any personal data of your own customers, and for its accuracy and legality.
The GROWBZ software, brand and design belong to us. You get a licence to use it — not to own it.
The Service, including all software, text, graphics, logos, designs and underlying technology, is owned by GROWBZ or its licensors and is protected by copyright, trademark and other intellectual property laws.
Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes during your subscription. No other rights are granted by implication.
You may not use the GROWBZ name, logos or trademarks without our prior written consent, except to identify GROWBZ as a service you use.
We aim for 99.9% uptime. If we fall short on a paid plan, you may be eligible for service credits.
We will use commercially reasonable efforts to make the Service available with a monthly uptime of 99.9%, excluding scheduled maintenance (for which we provide advance notice where practicable) and events beyond our reasonable control.
Our liability is capped at what you paid us in the last 12 months. We’re not liable for indirect or consequential losses.
To the maximum extent permitted by applicable law, GROWBZ and its officers, employees and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Service.
GROWBZ’s total aggregate liability arising out of or relating to these Terms shall not exceed the total fees paid by you to GROWBZ in the twelve (12) months preceding the event giving rise to the claim.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, except as expressly stated in these Terms.
You can cancel anytime. We can suspend or end your account if you breach these terms. You can export your data before it’s deleted.
You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period. We may suspend or terminate your access if you materially breach these Terms or fail to pay fees when due.
These terms are governed by Indian law, and disputes are handled by the courts of Mumbai, Maharashtra.
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.
The courts located in Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service.
We may update these terms. If changes are significant, we’ll give notice, and continued use means you accept them.
We may modify these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 15 days before they take effect, and update the “Last updated” date above.
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of them. If you do not agree to the changes, you must stop using the Service.
